Can I exceed the capacity of a yacht?
This is one of the most common questions we receive, and the answer is clear and definitive: No, it is absolutely not possible to exceed a yacht’s legal passenger capacity.
Many clients tell us they are a group of 12 people and therefore need at least 6 cabins, yet ask for a yacht with only 5 cabins because they assume it might be cheaper. However, the number of cabins does not determine the price of a yacht. Rates depend on many other factors, such as yacht size, crew, equipment, build quality, and luxury level (as explained in a previous blog).
Why You Cannot Exceed Yacht Capacity
Every commercial yacht is officially registered with a maximum legal passenger capacity. This includes adults, children, and even babies—every person counts toward the total.
If a yacht is registered for 12 passengers, then 12 is the absolute limit.
Not 13.
Not 12.5.
Not even “one small child extra.”
The capacity is fixed by maritime law and is strictly regulated. Exceeding it is a serious legal offense.
What Happens if You Exceed Capacity?
Some owners may be willing to “look the other way,” but the risk is entirely yours. If the harbor police check the yacht during your charter and the passenger list does not match the official papers, the consequences are severe:
-
Your cruise can be stopped immediately
-
The yacht may be fined or detained
-
Your holiday is officially over
This is why it is vital to always book a yacht with the correct number of cabins and the correct legal capacity for your group.
Bigger Boats Are Not Always More Expensive
A common misconception is that more cabins automatically mean a higher price. In reality, a yacht with more cabins can sometimes be more affordable than a smaller one. Prices depend on the yacht’s overall category, age, refit level, and luxury standards—not solely on cabin count.
Final Advice
Before requesting yacht options, always confirm the exact number of guests, including children and infants. This allows us to select only the yachts that are legally and safely suitable for your group—ensuring a smooth, stress-free holiday on the water.
